This Refund & Cancellation Policy applies to vehicle pre-orders placed with Car Theory BD. It is part of our Vehicle Pre-Order Terms & Conditions. In case of any difference, the full Terms & Conditions and the customer’s signed/written documents shall prevail.

1. Booking / Security Amount

• A booking/security amount is required to start the pre-order process.
• The booking/security amount shall be adjusted with the final vehicle price or refunded according to the cancellation and refund policy stated herein.
• Payments may be made through cash, bank transfer, mobile financial service, online payment gateway, or any other official payment method accepted by Car Theory BD.

2. Cancellation by Customer

• Before the vehicle is successfully purchased from Japan, the customer may cancel the pre-order.
• In such case, the refundable booking amount shall be refunded within 7–15 working days, after deducting any non-refundable bank charge, payment gateway charge or transaction cost, if applicable.
• Once the vehicle has been successfully purchased from Japan based on the customer’s written approval, the pre-order shall be treated as a confirmed purchase commitment. After this stage, the customer shall not be entitled to cancel the order as a normal cancellation.

3. Bank Loan Cases

• If the bank loan is not approved before the vehicle is purchased from Japan, the refundable booking amount shall be refunded to the customer.
• If the vehicle is purchased after loan approval, written confirmation, purchase order or payment commitment from the customer, and the customer later fails to complete the required payment, customer default and cancellation liability shall apply under these Terms & Conditions.

4. Cancellation by Car Theory BD

• Car Theory BD may cancel a pre-order if a suitable vehicle cannot be secured, the vehicle becomes unavailable, supplier fails to proceed, regulatory restriction applies, pricing or documentation issue arises, or any other valid unavoidable reason occurs.
• In such cases, the refundable amount shall be refunded to the customer.
• If the vehicle materially differs from the final written approval, auction sheet, grade, mileage, package or agreed specification due to Car Theory BD’s error, Car Theory BD shall review the matter and may provide reasonable remedy, adjustment, replacement sourcing or refund, depending on the nature of the issue and applicable circumstances.

5. Customer Default After Purchase

• If the customer refuses to proceed, fails to complete the required payment, or refuses to take the vehicle after it has been purchased from Japan, Car Theory BD shall have the right to re-auction, resell, transfer, or otherwise dispose of the vehicle.
• In such case, the customer shall be liable to bear all actual re-auction/resale charges, Japan-side costs, documentation costs, exchange losses, administrative/service costs, and any other actual financial loss incurred by Car Theory BD.
• If the vehicle has already been shipped from Japan after the customer’s written approval and the customer refuses to take delivery or fails to complete the required payment, the customer shall be liable to pay the vehicle’s actual Japan purchase value, excluding shipment/freight cost and LC/bank payment amount.
• Any additional actual loss, re-auction/resale cost, documentation cost, exchange loss, administrative/service cost, legal recovery cost, or other expense incurred by Car Theory BD due to such refusal or default shall also be borne by the customer, subject to applicable law and final settlement.
